Terms of Service | A Mom Exchange

1. Acceptance of Terms

By accessing or using A Mom Exchange ("the Service"), including our website, newsletter, and Childcare Exchange platform, you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.

2. The Exchange Membership

Eligibility: The Childcare Exchange is available to parents and guardians 18 years of age or older residing in the Traverse City, Michigan area.

Background Checks: All Exchange members must complete a background check through our third-party verification provider before gaining full access to the community. A Mom Exchange reserves the right to approve or deny membership at its sole discretion.

Subscription: Access to the Exchange requires a monthly subscription of $20/month, billed through our secure payment processor.

3. Payments & Refund Policy

Billing: Subscriptions are billed monthly. Your subscription will automatically renew each month unless you cancel.

No Refunds: All payments are non-refundable. You may cancel your subscription at any time to prevent future charges, but no refunds will be issued for the current billing period.

Cancellation: You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period, and you will retain access until then.

4. Background Check Disclaimer

A Mom Exchange requires background checks to promote community safety. However:

Background checks are performed by a third-party provider and A Mom Exchange does not guarantee the accuracy, completeness, or reliability of background check results.
A passed background check does not guarantee the character, behavior, or trustworthiness of any member.
A Mom Exchange is not responsible for the actions, conduct, or behavior of any member, whether they have passed a background check or not.
Parents and guardians are solely responsible for evaluating the suitability of any childcare arrangement and for the safety and supervision of their children at all times.

5. Member Conduct

As a member, you agree to:

Provide accurate and truthful information in your profile
Treat all members with respect and courtesy
Not use the platform for commercial solicitation or spam
Not share another member's personal information outside the platform
Not upload inappropriate, offensive, or illegal content
Report any concerning behavior to A Mom Exchange immediately

A Mom Exchange reserves the right to suspend or terminate any account that violates these terms, without refund.

6. Childcare Arrangements

A Mom Exchange provides a platform for parents to connect. We are not a childcare provider, employer, or agency. Specifically:

All childcare arrangements are made directly between members
A Mom Exchange is not a party to any childcare arrangement and assumes no liability for such arrangements
Members are responsible for setting their own terms, compensation (if any), and schedules
Members are solely responsible for ensuring appropriate insurance and liability coverage for any childcare activities

7. Photos & Content

By uploading photos or content to A Mom Exchange:

You represent that you have the right to share such content
You grant A Mom Exchange a limited license to display the content to other verified members
Photos are stored securely in encrypted cloud storage and are visible only to verified, subscribed members
You may delete your photos at any time through your profile
You agree not to download, screenshot, or redistribute other members' photos without their explicit consent

8. Reviews & Ratings

Members may leave reviews for other members they have connected with. Reviews must be honest, fair, and based on actual experience. A Mom Exchange reserves the right to remove reviews that are fraudulent, defamatory, or violate community guidelines.

9. Limitation of Liability

To the fullest extent permitted by law:

A Mom Exchange is provided "as is" without warranties of any kind
A Mom Exchange shall not be liable for any indirect, incidental, special, consequential, or punitive damages
A Mom Exchange shall not be liable for any loss, injury, or damage arising from interactions between members or childcare arrangements facilitated through the platform
Our total liability shall not exceed the amount you paid to A Mom Exchange in the 12 months preceding the claim

10. Indemnification

You agree to indemnify and hold harmless A Mom Exchange, its owners, operators, and affiliates from any claims, damages, or expenses arising from your use of the Service, your childcare arrangements, or your violation of these Terms.

11. Termination

A Mom Exchange reserves the right to suspend or terminate your account at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately.

12. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated Terms. We will notify members of significant changes via email.

13. Governing Law

These Terms are governed by the laws of the State of Michigan. Any disputes shall be resolved in the courts of Grand Traverse County, Michigan.
